Terms and Conditions

By the Numbers is a Shopify analytics and segmentation app operated by Unsupervised LLC ("we", "us"). By installing the app on Shopify or using bythenumbersapp.com you agree to these terms.

1. The service

We provide a hosted analytics dashboard, customer segmentation, cohort and RFM reports, predictive forecasting, and third-party platform sync (Klaviyo, Meta, Google Ads, TikTok) for Shopify merchants. The exact features available depend on your plan.

2. Trial

Every plan includes a 14-day free trial. We do not require a credit card to start the trial. If you do not actively choose a paid plan by day 15, access to the app is suspended automatically — there is no card on file to charge.

3. Billing

Once you choose a plan, billing is handled by the Shopify Billing API. Charges appear on your Shopify invoice. We do not store your payment details. You can cancel at any time from your Shopify admin; cancellation takes effect at the end of the current billing period.

4. Acceptable use

You agree not to:

• Reverse-engineer the service or attempt to extract source code
• Use the service to violate any law, including data-protection law in your jurisdiction
• Use customer data we process for you in any way that violates your own privacy policy or your customers' consent
• Resell, sublicense, or expose the service to third parties as a hosted product

5. Your data

You retain ownership of all data sent to the service from your Shopify store. We process it on your behalf in accordance with our privacy policy. You are responsible for ensuring your use of segmentation and sync features complies with your customers' consent.

6. Service availability

We target 99.5% monthly uptime. Scheduled maintenance is communicated in advance via the in-app notification banner and the support email. We do not provide uptime credits unless explicitly written into a custom agreement on the Unlimited plan.

7. Termination

You can uninstall the app from your Shopify admin at any time. We can suspend or terminate accounts that breach these terms, attempt to abuse the service, or fail to pay outstanding charges. On termination, the data-retention rules in our privacy policy apply.

8. Liability

The service is provided as-is. To the maximum extent permitted by law, our liability for any claim arising from your use of the service is limited to the fees you paid us in the 12 months preceding the claim. We are not liable for indirect or consequential damages.

9. Changes to the service or terms

We may add, remove, or change features. If a change materially reduces the functionality of your plan, we will notify you by email and offer a downgrade or refund of the unused portion of your current billing period.

10. Governing law

These terms are governed by the laws of the State of Delaware, United States. Disputes that cannot be resolved by direct discussion will be handled in the courts of Delaware.
